The procedure for selecting the purchase and sale of w/w machines will be carried out in accordance with the Seller's Rules of Procedure. 17.08.2026, which is an annex to this notice, and will also be sent by e-mail or mail to all interested parties. The best bid will be selected by the syndicate based on the highest purchase price offered taking into account the effects of a possible additional oral telephone auction. A telephone auction may be carried out if offers with the highest offered net purchase price differ by no more than 450 PLN (equivalent offers differing by not more than 5 % of the minimum selling price). Participation in a telephone auction is voluntary. The conditions for the participation of the tenderer in the additional telephone auction shall be the availability of the offerer's telephone when the tender is dealt with. Following the auction will be 1 % of the highest offered net purchase price rounded up to the full gold. 9. The selection of the offer made by the syndicate shall be subject to the approval of the Judge Commissioner. 10. The tenderer whose tender will be considered the most advantageous and whose choice will then be approved by the Judge Commissioner shall be entitled and obliged to purchase the machine which is the subject of this proceeding. 11. The tenderer whose tender will be selected and whose selection will be approved by the Judge Commissioner shall be obliged to pay the remaining part of the gross purchase price, outside the security, within 14 (14) days of the date of notification of the approval of the choice of the offer by the judge of the Commissioner. 12. The deposit and deposit remaining outside the deposit of the part of the purchase price shall be deemed to have been made only if they have fully paid, together with the VAT due, into the bank account of P.U.H.P. DOMPOL Sp. z o.o. in Wałbrzych indicated in section 4. 13. The security lodged by the tenderer whose tender is selected and whose selection is approved by the Judge Commissioner shall be credited against the selling price; the remaining tenderers shall be reimbursed without interest within 14 working days of the date on which the choice of the tender is accepted by the judge of the Commissioner. 14. If, for reasons attributable to the tenderer, the remaining part of the gross purchase price is not paid outside the security within 14 days of the date on which the Judge Commissioner's choice of the offer is notified, the security lodged by the tenderer shall be forfeit in favour of the bankruptcy of P.U.H.P. DOMPOL Sp. z o.o. in Wałbrzych, and the results of the approval of the selection of the offer expire. 15. The issue to the buyer of the machinery subject to this offer shall take place within a period determined separately between the receiver and the buyer, after payment of the total gross purchase price; the receipt of the machine shall be within 14 days from the date of payment by the buyer at the latest of the whole purchase price. 16. The demolition, loading and transport of the purchased machine the buyer organizes his own efforts and at his own expense. 17. In cases not governed by these conditions, Polish law shall apply, in particular the provisions of the Insolvency Law and the Civil Code. 18. The Syndicator reserves the right to withdraw from the sale at any stage of the proceedings without giving reason and without selecting any offer, the right of cancellation or cancellation.
