NOTICE OF THE SALE OF FALLABLE IMMOVABLENESS The Bankruptcy Syndicate announces the sale by hand in the tender contest, at the highest price offered, not less than PLN 12.400,00 (in words: twelve thousand four hundred zlotys) of the property comprising: right of ownership of unbuilt land property located in the Łódź Voivodeship, bełchatowski pow, obręb nr 0004 . Antonina, including plot No 31 pow. 0,5400 ha, for which the District Court in Bełchatów, the 5th Department of Eternal Books maintains the perpetual book PT1B/00050910/9, under the following conditions: 1) National and foreign natural and legal persons and organisational entities with legal capacity and capacity to perform legal activities may participate in the competition; the provisions of the Law of 24 March 1920 on the acquisition of immovable property by foreigners apply to foreign entities (codification of the text). U. z 2016 r., poz. 1061) 2. the offer under the strict principle of rejection should include: a. Company and registered office (in the case of natural persons, first name and address of residence, no pesel of the tenderer) b. in the case of tenderers who are not natural persons, the current discharge from the relevant register documenting the right to make binding statements of will on behalf of the entity concerned by the person who has signed the tender and, if the tender is signed by the representative, the power of attorney signed in accordance with the principle of representation, c. an indication of the asset to which the tender relates together with the offered purchase price in net value expressed in terms of amounts and words which may not be lower than that indicated in the call price, d. the obligation of the purchaser to cover costs, taxes and charges relating to the conclusion of the contract, e. a statement that the tenderer has taken note of the fact and legal status of the subject-matter of the sale, accepts it, raises no objections to it and waives any claim for that purpose in the future, and also that there are no factual or legal reasons which would restrict or prevent the conclusion of the contract in the event of the selection of its tender, f. the original signature of the natural person tenderer or the signatures of the persons authorised to represent the tenderer who is not a natural person on the tender and declarations, g. a statement that the tenderer has the means to pay the price offered and to ensure that the purchase price is paid once so that it can be fully received by the syndicate in a notarial act, h. a statement of readiness to enter into an agreement in the event of a successful tender contest, at the place and time indicated by the syndicate, i. a statement of review of the rules of sale (competition of tenders) and acceptance without reservation, j. proof of payment of the security, k. an indication of the bank account number to be returned if the offer is not accepted, I. any authorisation and consent if they are required by law by reason of the purchaser. 3) tenders should be submitted only in Polish in a sealed envelope with the designation "Antonina," sent by registered letter or courier by 20 April 2021 to the address: Dorota Borkowska "The Syndicate of the Mass of Fallenty," 91-498 Łódź, Okoniowa 7/2, (decides the date of delivery to the given address). The offer or any statement contained therein may not be made on condition, subject to the time limit, nor may it be variant. The participant of the tender contest shall be bound by an offer up to the expiry of the time limit set by the syndicate for the conclusion of the contract; 4) When entering a competition under the strict rule of rejection of his offer, he should pay a security to a bank account with the number: 89 1140 2004 0000 3202 7183 8350, led by the bankruptcy syndicate, amounting to 10% of the call price, i.e. PLN 1.240,00 (in words: one thousand two hundred forty zlotys) and attach proof of payment to the tender submitted. The security paid by the participant who won the tender contest shall be counted against the selling price. The security shall be forfeit in favour of the bankruptcy in the event of a cancellation or withdrawal of the participant who has won the tender contest from the conclusion of the sale contract in the form of a notarial act within the time limit set by the syndicate; 5. the opening and selection of tenders shall take place on 21 April 2021 and the selection of the tender shall be determined by a protocol; 6. the selling price of the gross real estate less the security paid in, should be paid in and recorded in the bank account of the bankruptcy at the latest prior to the conclusion of the sale contract; 7. any cost of concluding a sales contract, including civil law tax, notarial and judicial charges shall be charged to the purchaser. If the provisions of the Act VAT provides for this, VAT will be added to the selling price accordingly. On the date of conclusion of the contract of sale in the form of a notarial act, the purchaser shall be entitled to benefits, taxes and other public tributes arising from the subject-matter of the sale; the public benefits of the non-repetitive acquirer shall be borne only if their payment is made on the date on which the contract is concluded in the format of the notarial instrument or after that date; 8. the additional terms of sale shall be laid down in the terms of the tender contest and the order of the Judge Commissioner authorising the syndicate to sell the property.
