NOTICE The bankruptcy syndicate announces a fourth tender for the sale of the company FABRYKA BIZNESU Sp. z o.o. in bankruptcy with its registered office in Łódź with additional oral auction option 1. The object of the sale is the company FABRYKA BIZNESU Sp. z o.o. in bankruptcy with its registered office in Łódź within the meaning of Article 551 of the Civil Code, which includes the assets indicated in the description and estimation of the company drawn up on 8 June 2020 by the judicial expert Wojciech Rogowski, in particular: a/ right of use of perpetual land property consisting of parcels with registration numbers 64/110, 64/111, 64/112, 64/113, 64/114, 64/115, 64/116, 64/117, 64/118 and 64/119, bordering P-29, town of Łódź, district Polesie, total area 31 499 m2 and property right of the Shopping Centre building, which is subject to separate ownership from the ground. This property is located in Łódź near Al. Politechniki 1; for real estate are run by the District Court for Łódź-Śródmieście, XVI Department of Books of Perpetual Books perpetual number: LD1M/00158445/7 and LD 1M/00117210/2, b/ movable property located within the CHR Succession, excluding movable property and investments owned by tenants, in particular those indicated in Annexes 1, 2, 3, 4, 5 to the Rules of Procedure, c/ industrial property rights, in particular trademark law R.268264. I inform you that the 4th floor of the Gallery with a usable area of 6.526.62 m2 is covered by the lease agreement. For the record, the area under the package is also occupied. 2. The undertaking covered by the invitation to tender shall not comprise: cash, claims and other components specified in the Rules of Procedure. 3. The starting price of the tender is PLN 85,000,000.00 (eighty five million 00/100 zlotys). The price does not include VAT in accordance with Article 6 (1). 1 Act on VAT on goods and services. 4. The description and estimation of the bankrupt undertaking and other documents necessary to carry out due diligence of the failing undertaking may be made available to the interested parties under the conditions detailed in the Rules of Procedure of the tender. If it is necessary to make available documents other than the description and estimation of the failed company necessary to carry out due diligence of the failing company, it is also necessary to submit a written statement of confidentiality of the data made available in connection with the tendering procedure and to pay a deposit of 50.00.00 (in words: fifty thousand zlotys) on the bankruptcy bank account. 5. The written offer to purchase the company FABRYKA BIZNESU Sp. z o.o. in bankruptcy with its registered office in Łódź must be submitted in a sealed envelope with the inscription "Business Factory" signed by Act XIV of the Gup 80/20 "NOT OPEN" by 6 August 2021 inclusive, up to and including 4 p.m. 14.00 p.m., to the following address: Kancelaria Notarialna Notariusz Grażyna Rymdejko, ul. Tenders which do not meet the conditions laid down in the Rules of Procedure or which have been received after the closing date for the submission of tenders shall not be considered and shall be rejected. 8. The opening and recognition of tenders will take place on 10 August 2021 at a public meeting in the District Court for Łódź-Śródmieście in Łodź Economic Court of the XIV Commercial Division for Bankruptcy and Restructuring Affairs (Łódz, ul. 37 Pomeranian), 3 p.m. Ten o'clock, room 314. 9. The tender is conducted by the Bankruptcy Syndyk under the supervision of the Judge-Commissioner. The syndicate shall open the tenders and choose the most advantageous of them or shall determine that the tender has been closed without the choice of any of the tenders. 10. Where equivalent tenders are submitted within the meaning of the Rules of Procedure, or where all tenders contain the same price, the Syndicator may carry out an additional oral auction under the conditions laid down in the Regulations. 11. The selection of the tenderer shall be made by the Syndicate; the selection shall be subject to the approval of the Judge-Commissioner. 12. The notice and the terms of the invitation to tender may be amended or revoked. 13. A tender may be closed without the selection of any tender. 14. The sale price less the security paid shall be paid to the bank account of the bankruptcy as indicated by Syndyk, not later than the day before the conclusion of the sale agreement of the bankrupt company. 15.
