Konopnicka 3/42, 64-200 Volsztin On the basis of the order of the Poznań District Court, the Old Town in Poznan XI Economic and Restructuring Department of 12 August 2021 in the case of Act XI Gup 280/17, the Bankruptcy Syndicate announces the procedure from a free hand by selecting the most advantageous offer for the sale of assets of the fallen Teresa Pietruszyńska, zam. ul. Konopnicka 3/42, 64-200 Wolsztyn. 1. Subject matter of sale 1.1. The object of the sale is the cooperative property right to the property located in Wolsztyn at ul. Konopnicka 3/42, for which the District Court in Wolsztyn IV Faculty of Perpetual Books holds a perpetual book under the number PO1E/00047500/9. 1.2. The starting price of the participation described in point. 1.1. is the highest price offered, not less than PLN 202.00.00 (say: two hundred two thousand PLN 00/100). 1.3. The sold premises were described in detail and valued in an estimated operation prepared by expert Robert Bałkowski on 2 June 2021. 1.4. The operation of estimated participation is available for inspection at the Syndic Office in Poznań at Al. Marcinkowskiego 1/6, 61-745 Poznań. 1.5. Judge of the Poznań District Court, the Old Town in Poznan, Economics Department of XI for Bankruptcy and Restructuring Affairs, Judge-Commissioner in bankruptcy proceedings of the bankrupt Teresa Pietruszyńska by decision of 12 August 2021 authorised the syndicate to sell the cooperative property right to the residential premises described in paragraph 1 above. 2.2. The sale of cooperative ownership right to a free-of-hand dwelling will take place in the form of a competition of offers. 3. Method of submission of tenders 3.1. Legal and natural persons may take part in the competition, excluding the syndicate and the persons referred to in Article 157a (1). 2 Bankruptcy Law Act. 3.2. The conditions for joining the competition are to submit in duplicate a written offer in Polish, either by personal mail or by registered letter with acknowledgement of receipt, by 6 September 2021 in closed and sealed envelopes to the following address: Syndyka, Al. Marcinkowskiego 1/6, 61-745 Poznań. 3.3. Content of the offer: a) One envelope with the inscription: Judge-Commander SSR Łukasz Lipowicz b) Second envelope with inscription: Syndicate of the mass bankruptcy of Teresa Pietruszyńska, Jakub Antkowiak 3.4. Tenders shall bear the signature of the act: XI Gup 280/17. 3.5. If tenders are sent by post, the day of receipt of tenders shall be decided on. 3.6. A written offer under the terms of its rejection shall include: (a) the exact name of the applicant: name (company), place of residence (seat) and contact phone number, (b) an e-mail address and a statement that the tenderer consents to the delivery of correspondence to the address given, (c) determination of the subject-matter of the sale to which the tender relates, (d) the price offered at least equal to the call price, expressed in figures and words; in the event of discrepancies, the price expressed in words shall be determined; (e) in the case of entrepreneurs: current discharge from the KRS or business records (CEIDG), and PESEL in the event of offers submitted by natural persons, (f) any authorisation and consent where they are required by law by reason of the purchaser, (g) in the case of commercial companies, a resolution of the relevant authority approving the acquisition of real estate, (h) a statement by the tenderer of its knowledge and acceptance of the sales regulations, (i) an obligation on the tenderer to pay all charges relating to the purchase (notarial tax, court fees, other taxes and charges), (j) a statement of knowledge of the legal and factual situation of the property offered by the Syndicate, and that he will not waive the contract and waive the guarantees pursuant to Article 558 (1) of the Civil Code, (k) the bank account number for a possible refund of the security in the event of a failure to win the contest, (l) proof of payment of the security. 3.7. The contestants shall be bound by the tender submitted until the time limit for the buyer's selection and the tenderer whose tender has been selected until the closing date for the conclusion of the sale contract. 4. Wadium 4.1. The condition for participation in the sale process is the payment by the tenderer of 5% of the call price to the bank account of the bankrupt Teresa Pietruszyńska operated by Santander Bank Polska S.A. with the number 39 1090 1447 0000 0001 3599 8686 with the addition of the note "Wadium XI Gup 280/17" and the payment mark. 4.2. The deposit date expires on 6 September 2021. 4.3. The date of impact of the security shall be deemed to be the date on which the entire amount of the deposit is recognised in the above-mentioned bank account. 4.4. The security of participants whose tenders will not be accepted shall be returned to the bank account indicated by the tenderer at the nominal amount within 14 (14) days from the date of consideration of the tenders. 5. Selection of tenders 5.1. The opening and processing of offers will take place at the Syndic Office in Poznań at Al. Marcinkowskiego 1/6 on 7 September 2021 at 9:00 a.m. 5.2. Where, following the opening of tenders, it is found that at least two correct tenders have been received with a proposal for acquisition referred to in point. 1.1 a share and at the same price as the highest bid price offered, the Syndicate may carry out an additional oral auction between these entities. To this end, within 3 (three) days of the opening of the tenders, the Syndicate shall send the tenderers' e-mail addresses to participate in the oral auction, indicating the date and place of the auction. The bidding will take place under the following conditions: (a) the call price shall be the highest price proposed by the tenderers admitted to bid, (b) the bidding will be carried out by raising the hand of the person involved in the oral auction and by giving a loud indication of the price offered, (c) the tender submitted during the bidding process shall be binding until a higher bid has been submitted, (d) the minimum amount of action shall be 1% of the call price rounded to the full thousand zlotys up, at a call price of not less than 100.000,00 zł or up to a full hundred zloty at a calling price of less than 100.000.00 zł, (e) it shall be awarded to a tenderer whose tender remains the highest three times after it has been repeated by the Syndicate. 5.3. In the case referred to in point. 5.2 if none of the eligible tenderers does not proceed to an oral auction, the syndicate shall accept as a successful written offer submitted previously. 5.4. From the opening of offers and oral auctions, the syndicate shall draw up a protocol. 6. Conclusion of a sales contract 6.1. Once the best bid has been fixed, the Syndicate shall immediately inform the successful tenderer. The syndicate shall also inform the other tenderers of the results of the proceedings. 6.2. The person to whom the offer is to be selected shall, within one month of the date on which Syndyk informs him of the choice of his tender, pay the amount offered to the bank account (less the security paid) and submit within the specified period to the notary firm designated by Syndyka for the purpose of concluding the sale contract. 6.3.
