JUDICIAL NOTICE on a written invitation to tender for sale of real estate of bankruptcy in bankruptcy proceedings under Act VI GUP 452/20/PD Bankruptcy syndicate, a natural person not engaged in economic activity, pursuant to Article 320 of the Law of 28.02.2003. Bankruptcy law and under the terms and conditions laid down by the Rules of Procedure of the Court of Justice approved by decision of 6 September 2021 in Case VI GUP 452/20/PD publish in writing an unlimited tender for the sale of assets of bankruptcy, including: residential premises constituting a separate property no. 11 located in Rumi at 19 Pomorskie Street, to which belongs cellar No. 11 with an area of 5,40m2, with a total usable area of 38,28 m2, for which the District Court in Wejherów IV Department of the Eternal Book runs the perpetual book No. GD1W/00081756/2 at the call price not less than PLN 196.930,00 (say: one hundred ninety six thousand nine hundred thirty zlotys 00/100). The sale and acquisition of the property will take place in the state in which it is situated on the date of sale. CONDITIONS OF THE TRANSPARENCY The detailed terms of the invitation to tender are laid down in the Rules of Procedure of the tender, which was submitted for inspection by persons interested in the syndicate in Wejherów at ul. The offer is to be drawn up clearly in the Polish language and must contain a clear: the name and address in the case of natural persons submitting the tender and the name or establishment of the economic activity, in the event of its operation, possibly the name, address and legal form where the tender is submitted by persons other than natural persons, up-to-date print-out or write-down of the National Courts or other relevant registers (applies to legal persons and organisational units to which the Act grants legal capacity), an indication of the NIP and REGON numbers (for entities with such a number) or the PESEL number in the case of natural persons, or a declaration that the person concerned does not have a PESOL number, an indication of the property to which the tender relates, the purchase price offered, which may not be lower than the call price referred to in paragraph 3. AND THE RULES OF PROCEDURE, a statement of the tenderer's commitment as a future buyer to cover all costs, taxes and charges relating to the conclusion of the contract and the transfer of property, a statement of inspection and acceptance of the terms and conditions of the Rules of Procedure of the tender, a statement that the tenderer does not belong to the circle of entities referred to in paragraph 4. 3 of the Rules of Procedure of the Court of First Instance, a statement that the tenderer has taken note of the factual and legal situation of the property concerned and of its technical condition and does not raise objections to it and agrees to the warranty for physical and legal defects under Article 558 § l of the Civil Code, the Ministry of Internal Affairs and Administration's permit prosecution in the case of tenderers who are foreigners within the meaning of the Law of 24 March 1920 on the acquisition of real estate by foreigners, if they have a statutory obligation to obtain permission to acquire real estate, a written statement that the tenderer or the bank or any other entity financing the purchase of the subject-matter of the tender is a tenderer or a bank, and that it is necessary to designate that entity; proof of payment of the full amount paid from the tenderer's account, an indication of the bank and the bank account number to be returned if the offer is not accepted; statements by a natural person of his or her marital status Documents drawn up in a foreign language will be submitted together with a juror's translation into Polish. 10. The offer and any statements attached thereto shall be accompanied by the signatures of the natural person of the case or by the signature of the persons authorised to reprimand a tenderer who is not a natural person in accordance with the form of representation. The representatives of the participants in the tender must also present the authority with the signatures of the persons giving the power of attorney, indicating that they are entitled to specific activities within the framework of this clause. All documents annexed to the tender shall be submitted in the original or a copy notarised for compliance with the original under the rigour of rejection. Once the number of tenders meeting the terms of the tender has been determined, the syndicate shall carry out a detailed examination of the tenders and select the most favourable of them or shall state that it has not selected any of the offers submitted. Where equivalent tenders are submitted, the administrator may freely select the tender or carry out an additional auction with the participation of tenderers who have submitted equivalent tenders and will be present at the hearing on the recognition of tenders. The Syndicate reserves the right to: withdrawal from the tender or cancellation of the contract in whole or in part, indicating which element of the tender is concerned without giving a reason; failure to choose an offer without giving a reason.
