Syndicate of the mass bankruptcy of Frost sp. z o.o. in bankruptcy with its registered office in Warsaw (hereinafter "Syndyk") invites you to submit offers in the competition, the object of which is the acquisition of a set of claims owed to FrosT sp.z.o in bankruptcy located in Warsaw, estimated by the expert judicial dr inż. Witold Kornacki of 8 July 2019 under headings 8, 9, 13, 16, 20, 26, 31, 33, 36, 40 and 41. The opinion of 8 July 2019 can be read at Syndyka's office, ul. Stanisław Augusta 75. 47, 03-846 Warsaw (Tel. + 48 22 639 45 55) upon prior appointment for the visit. The Syndicator declares that he is in possession of decompleted documentation concerning the claims which are the subject of the tender contest. Where a person interested in the acquisition of the subject-matter of the tender for the assessment of his or her factual and legal situation considers it appropriate to obtain information that goes beyond the scope of the information held by Syndicus, such information shall in such a case remain solely the responsibility of the person concerned to acquire the subject matter of the contest and shall be at the expense of, and Trying such a person, knowing the Syndicate. Starting price: PLN 136,225,66 (in words: one hundred and thirty-six thousand two hundred and twenty-five zlotys and sixty six cents). Payment of the price by way of compensation with any debts owed to the tenderer vis-à-vis FROST sp. z o.o. in bankruptcy with its registered office in Warsaw is excluded. The syndicate is entitled to exclude from the sale those debts or parts thereof, which until the date of conclusion of the contract for the assignment of claims of the Fallen (including that date) will be settled in favour of the bankruptcy of Frost sp. z o.o. in bankruptcy with its registered office in Warsaw, in which case the sale price of the claim will not be reduced by the amount paid to the bankruptcy mass. Written tenders containing the documents and declarations referred to in Section 2 (1) of the Rules of Procedure of the tender contest shall be submitted by 6 July 2021 at the office of Syndyka, ul. Stanisław Augusta 75. 47, 03-846 Warszawa. The Syndicator reserves that the offers sent to the post office, if not delivered to the Syndicate by 6 July 2021 at the latest, will not take part in the competition (in this case the date of the post stamp confirming the award of the offer in the post post office will not be relevant). The offerer is obliged to pay a security deposit of PLN 20.00.00 (20 thousand 00/100) on the bank account of the bankruptcy mass of Frost sp. z o.o. in bankruptcy conducted in Santander Bank Polska S.A. with its registered office in Warsaw. The time limit for the opening of tenders shall be 8 July 2021 at 10 p.m. 12:30, Syndyk's office, ul. Stanisław Augusta 75. 47, 03-846 Warszawa. In the event that at least two tenderers have submitted tenders satisfying the requirements of the formal rules of procedure of the tender contest containing a price not lower than the reference price referred to in paragraph 1 (3) of the Rules of Procedure of the contest, the Syndicator shall carry out an auction (or oral auction) between those tenderers. The auction will take place on the day of opening of the tenders, i.e. On 8 July 2021, at Syndicate's office, at 3 p.m. 12:30, as an integral part of the bid contest.
