These Rules of Procedure apply to a written invitation to tender for the sale of a company forming part of the bankruptcy of Browar Kościerzyna sp. z o.o. in bankruptcy with its registered office in Kościerszyn pursuant to Article 320 of the Law of 28 February 2003 at a price not lower than the initial price specified in §3 of the Rules of procedure of the tender. 1. The subject of the invitation to tender is the sale of a wholly owned company consisting of movable property and immovable property at a call price of not less than PLN 13887.062 ,76 . Sales exempted from VAT as this is the sale of the entire company. a) Built-in land property, which is a plot of land No 179/46, 179/49 (abbreviation 0003), with a total area of 10.414 m2, located in the village of Kościerzyna ul. Brown 1, for which the District Court in Kościerzyn IV Department of Perpetual Books runs the perpetual book No GD1E/00047235/8. The property is built in a production and warehouse building adapted to a beer production plant worth PLN 10.622,00.00 net. (b) Movements constituting the equipment of an undertaking of a value of PLN 7.550.451,00 net. 2. The sale and acquisition of the company will take place in the state in which it is situated on the date of sale. The tender may be open to natural persons, legal persons and organisational units which are not legal persons to which the Act grants legal capacity, provided that they deposit a security. The subject matter of the tender is currently leased on the basis of a lease agreement concluded on time marked until 05 December 2027.
