The bankruptcy mass syndicate invites all interested to submit offers for the purchase of movable property in the form of a collection comprising 929 items of spare parts and accessories for professional cleaning and cleaning equipment (including filters, valves, gaskets, nozzles, brushes, etc.), a detailed list in the attachment. The submission of an offer is tantamount to familiarising themselves with the technical, factual and legal status of the subject-matter of the competition and its acceptance and the absence of any objections. The purchaser notes that the sale in bankruptcy proceedings has the effect of enforcing the sale (Article 313 § 1 p.u.) and that the right to withdraw from the contract after the conclusion of the contract as well as the right of guarantee for defects (Article 558 §1 k.c., Art. 879 k.p.c). A list of the movable property to be tendered was drawn up on the basis of the records of the fallen stock, without carrying out the inventory by nature. The list shall be informative and shall not ensure that the Syndicus complies with the actual quantity, type, completeness or condition of mobility indicated therein. The syndicate will allow tenderers to inspect the movable property before submitting the tender, within a time limit agreed with the Syndicate, in order to verify the data contained in the list and to learn about the actual quantity, completeness and condition of the movable assets. The tenderer should verify the subject-matter of the tender himself before submitting the tender. The submission of a tender shall mean taking note of the manner in which the list is drawn up and accepting the risk of a discrepancy between the data contained in the list and the actual situation. Failure by the tenderer to take advantage of an inspection shall not exclude or limit the effects of the acceptance of that risk. The Syndicus' liability for deficiencies, inaccuracies or discrepancies between the list and the actual quantity, type, completeness or state of the movement shall be excluded. The price offered by the purchaser shall be the price for all the movable property covered by the tender in their actual state and quantity. Any shortcomings, inaccuracies or discrepancies in relation to the list shall not lead to a change in the purchase price or give rise to a request for a reduction.
