The syndicate established in the insolvency proceedings HR LEGAL sp. z o.o. announces the first competition of offers for the sale of claims held by the company. The contest of offers and sales will be conducted in accordance with the following rules:I. The subject of sale is a claim of PLN 1.724.726,00 together with interest resulting from damage to the company's assets due to p-actions. Marleny Antkowiak (former member of the company's board of directors).II. Each of the auctioneers can make one offer.III. Written offers in Polish can only be submitted by letter (by courier service or by means of a public postal operator . Poczta Polska S.A.) in a sealed envelope by 3 November 2026 inclusive, to the address of the syndicate: Lawyer's Office Sławomir Parus, ul. Rainbow 4/2, 60-275 Poznań with a clear inscription on the envelope: .Offer of purchase of receivables . HR Legal sp. z o.o. (decides the date of delivery of the offer to the given address).IV. Tenders shall include:· proof of deposit of 10% of the minimum selling price of the claim on the bankruptcy account,· a declaration of familiarity with the terms of sale and acceptance without reservation,· the original, legible signature of the tenderer,· in the case of tenderers not being natural persons, the current extract from the relevant register documenting the right to the submission of binding statements of intent on behalf of the entity by the person who has signed the tender and, if the tender is signed by the representative, the mandate signed in accordance with the principle of representation, the statement that the tenderer has been informed of the facts and legal status of the subject-matter of the sale and does not raise objections to it, the full details of the tenderer (in particular PESEL or KRS, NIP, telephone, e-mail).V. At the latest on the last day of the time limit for the submission of tenders, the person submitting the tender must pay a security deposit of 10% of the minimum selling price of the claims on the account of the bankruptcy estate: HR Legal sp. z o.o. in bankruptcy, ul. The security deposit paid by the participant whose offer is considered to be the most favourable shall be credited to the selling price; the security deposit lodged by the other participants shall be refunded immediately after the selection of the best offer.VII. The tenderers may be national and foreign natural persons, legal persons and organisational entities with legal capacity and legal capacity.VIII. Sales are run by Syndyk.IX. The Syndicate shall open the tenders and choose the most advantageous of them or determine that the competition for tenders has been closed without the choice of any of them. In the event of the impact of more than one most advantageous offer, Syndyk reserves the right to hold an additional round of tenders among the tenderers who have submitted the most favourable offers.X. The outcome of the tender contest will be notified to all tenderers submitting an offer..XI. Announcement and terms of the contest of tenders may be changed at any time.XII. The syndicate shall conclude a contract of sale within one month of the selection of the offer. The Syndicate may extend the period until the conclusion of the contract.XIII. The participant of the tender contest is bound by the offer until the expiry of the above deadline. The sale price less the security deposit paid should be paid and entered in the bankruptcy account at the latest on the date of conclusion of the sale agreement.XV. Where a tenderer whose tender has been selected by Syndyk is not able to conclude a contract for the sale of the claim or the payment of the entire purchase price within a fixed period, he shall lose the right to acquire the claim and the security deposit shall be forfeit in favour of the bankruptcy.XVI. On the date of conclusion of the contract of sale to the buyer, the benefits of the claim and possible charges are passed on.XVII. Any cost of concluding a sales contract shall be borne by the buyer.XVIII. The seller is not liable for any legal defects, nor does he provide warranty or warranty on the rights which are the subject of the sale.XIX. The Syndicate reserves the right to withdraw from the sale at any time without giving a reason.XX. In cases not regulated under the terms of sale, the provisions of the Insolvency Law and the Civil Code will apply.
