Syndyk Masy Pleasantów announces a competition of offers for the sale of 1⁄2 shares in the residential property No. 17, located in Krakow at ul. Aqueous 40a, with which a share of the common property is owned, which is the land and parts of the building and equipment which are not exclusively used for the use of the owners of the premises, of 301/17150 parts. For this residential premises, the District Court for Krakow - Podgórze in Kraków - 4th Faculty of Perpetual Book is kept by KR1P/00319573/1. The participation is part of the bankruptcy mass in bankruptcy proceedings of a natural person who is not engaged in business activity, i.e. act KR1S/GUp/115/2024. The estimated market value of the share for non-forced sales, according to the operation prepared by the expert of the court, is PLN 216.00.00 (two sixteen thousand zlotys). The starting price is 70% of the estimate price for non-forced sales, i.e. 151.200,00 zł (in words: one hundred fifty-one thousand two hundred zlotys 00/100). No. 73 1600 1462 1772 1601 8000 0001. The security shall be paid by 16 November 2026 at the latest. If the offer is not accepted, the security shall be refunded. The Syndicate shall open the tenders and select the most favourable offer, close the competition without selecting any of the tenders, or bid pursuant to paragraph 2.8 of the Rules of Procedure. The offer shall include: (a) details of the subject matter of the tender, (b) the tenderer concerned: the company or business name, office or address of the tenderer, the imprint of the successful firm stamp, the legal status of the bidder, the NIP, the REGON number, the signature and the name stamp of the person acting on behalf of the offeror, together with the document showing his/her power to act in the name of the tender (in the case of the trader), the PESEL number and the identity card number (in case of a natural person) non-business), e-mail and contact phone number; (c) current (i.e. not earlier than one month before the closing date for the submission of tenders) discharge from the relevant register/printing with CEiDG in the case of traders, a copy of the identity card (in the case of an identity card it is permissible to identify the identity); (d) a statement of review and acceptance of the Rules of Procedure without reservation, (e) the proposed purchase price (not lower than the call price) expressed in digits and in words; (f) confirmation of the payment of the security (in accordance with point 1 (a) (b))) and the bank account number to which the security paid must be returned in the event of failure to accept the offer; (g) a statement that the tenderer has become aware of the facts and legal status of the property and accepts it without reservation; (h) for foreign entities additionally: the legal consent required for the acquisition of the property, the sworn translation of the content of the offer and the documents attached thereto; (i) in the case of natural persons additionally: the consent of the spouse to submit an offer and purchase the subject of sale, or a declaration that the tenderer is not married or a statement that the successful tenderer remains in a marriage in which the distribution system is in force or a declaration that the subject of the sale is acquired by the tenderer for his personal property by means of his personal assets; (j) in the case of legal persons in addition: the consent of the authorised authority of the legal person to acquire participation under the conditions laid down in the offer, together with an extract from the instrument of incorporation of a legal person indicating the competence of the authority granting consent in this respect. In the event of the impact of more than one valid bid accepted by the syndicate, an oral auction shall be carried out. The bidding will not be carried out if the difference between the following bids is equal to or greater than 10%.
