VD 17 1:019133X or 39:54397W. – Kulpis (1652-98) belongs as a pupil Obrechts to the school of early Reichspublizistik in Strasbourg, which tried not only to justify the Reichsstaatsrecht not only legally, but also politically and historically. In Germany, he is at the same time one of the early critics of the claim to the validity of Roman law by opposing the then ruling opinion that the reception of his legal propositions is a fundamental assumption which the opponent must refute in each individual case if he wanted to enforce particular German law against it. He also sought to banish Roman law from the Reich State Law and only allowed the Reichslegislation and the coming of the Reich to be regarded as a source of law. In this work he takes his position on the famous writing of Pufendorf's 'De Statu Imperi Germanici', published under the pseudonym Severinus de Monzambano. He turned against his gloomy prediction that the empire would become a confederation of states on the basis of the guarantee of sovereignty granted by the Osnabrück peace, and against the qualification of the empire as an 'irregular aliquid corpus monstro simile'. For Kulpis, the state form of the empire is a respublica mixta composed of elements of the monarchy (the emperor) and the aristocracy (the imperial states) by the iura majestatis jointly to the emperor and the imperial states. – Lightly tanned, title with handwritten possession entry in ink.
